Welcome to ZenBooky. These Terms and Conditions (“Terms”) govern your access to and use of the ZenBooky platform, website, and services (collectively, the “Service”). By accessing or using ZenBooky, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

“Customer” refers to end users who book appointments through a User’s booking page.
“Content” means any data, text, images, or information submitted through the Service.

2. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms. By using ZenBooky, you represent and warrant that you meet these requirements.
3. Account Registration
To access certain features, you must create an account. You agree to:
Provide accurate, current, and complete information
Keep your login credentials secure
Be responsible for all activities that occur under your account
ZenBooky is not responsible for unauthorized access resulting from your failure to safeguard your credentials.
4. Use of the Service
You agree to use ZenBooky only for lawful purposes and in accordance with these Terms. You may not:
Use the Service for fraudulent or deceptive activities
Interfere with or disrupt the integrity or performance of the Service
Attempt to gain unauthorized access to systems or data
Use the Service to distribute malware, spam, or harmful content
5. Bookings and Appointments
ZenBooky provides scheduling and booking tools only. ZenBooky:
Is not a party to any agreement between Users and their Customers
Does not guarantee appointment attendance, availability, or outcomes
Is not responsible for disputes, cancellations, refunds, or services provided by Users
All appointment terms are solely between the User and their Customers.
6. Payments and Subscriptions
Certain features may require payment or a subscription.
Prices and billing terms are displayed at the time of purchase
Subscriptions renew automatically unless canceled
All payments are non-refundable unless otherwise stated
ZenBooky reserves the right to modify pricing or plans with reasonable notice.
7. Custom Domains
ZenBooky may allow Users to connect custom domains.
Only subdomains using CNAME records pointing to zenbooky.com are supported
Users are responsible for their own DNS configuration
ZenBooky is not responsible for downtime caused by incorrect DNS settings
8. Intellectual Property
ZenBooky and all related trademarks, logos, and software are the exclusive property of ZenBooky. These Terms do not grant you any rights to use ZenBooky branding without prior written consent.
Users retain ownership of their own Content but grant ZenBooky a non-exclusive, worldwide license to use it solely to operate and provide the Service.
9. Data, Privacy, and Third-Party Integrations
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
Where applicable, ZenBooky may integrate with third-party services such as payment providers, messaging services, analytics tools, or calendar services (including Google Calendar). Use of such integrations is subject to the respective third-party terms, privacy policies, and user consents. ZenBooky only accesses third-party services when explicitly authorized by the User.
10. Service Availability and Best-Effort Basis
ZenBooky is provided on a best-effort basis, without any service level agreement (SLA) or guaranteed uptime. While we strive to maintain high availability and reliable performance, we do not warrant that the Service will be uninterrupted, error-free, or available at all times.
We may, at our sole discretion:
Perform maintenance or updates
Modify, suspend, or discontinue features
Temporarily restrict access for operational, security, or technical reasons
ZenBooky shall not be liable for any resulting downtime, data loss, or business impact.
11. Termination
We may suspend or terminate your account at any time if you violate these Terms or misuse the Service. You may cancel your account at any time through your account settings.
Upon termination, your right to use the Service will immediately cease.
12. Limitation of Liability
To the maximum extent permitted by law, ZenBooky shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.
ZenBooky’s total liability shall not exceed the amount paid by you to ZenBooky in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless ZenBooky from any claims, damages, liabilities, and expenses arising from:
Your use of the Service
Your violation of these Terms
Your interactions with Customers
14. Changes to These Terms
ZenBooky may update these Terms from time to time. Changes will be effective upon posting. Continued use of the Service after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles.
